Reward of Service and Extended Warranty Terms and Conditions

1. About These Terms and Conditions. These terms and conditions (“Terms”) govern the collection and use of the reward of Service and Extended Warranty (“Service and Extended Warranty Reward”). By redeeming the Service and Extended Warranty Reward in accordance with the Milwaukee Tool Thailand Heavy Duty Club Terms and Conditions, you agree to be bound by these Terms, together with our Privacy Policy and Warranty Terms and Conditions. For the avoidance of doubts, you are still bound by the Milwaukee Tool Thailand Heavy Duty Club Terms and Conditions.

2. Definitions. Unless otherwise defined herein, capitalized terms used in these Terms shall have the same meanings as those defined in the Milwaukee Tool Thailand Heavy Duty Club Terms and Conditions and Warranty Terms and Conditions.

3. About the Service and Extended Warranty Reward. The Service and Extended Warranty Reward includes the following:

1. Extension of the Warranty Period of the Selected Product (as defined in Clause 5 below) for one (1) year (“Warranty Period Extension”);
2. Coupon for one (1) time free inspection, calibration or oil change (“Free Inspection/ Calibration/ Oil Change”); and
3. Coupon for one (1) time free loan of product (“Free Tool Loan”), subject to these Terms.

4. Redemption of Service and Extended Warranty Reward. You, as a Heavy Duty Club member, may redeem the Service and Extended Warranty Reward using one thousand (1,000) Points, provided that:

1. At the time of redemption, you have at least one (1) Product which has been registered for Warranty in accordance with the Warranty Terms and Conditions, and the Warranty Period of which has not expired (“Eligible Product”); and
2. You redeem the Service Plus Reward one month before the warranty expiry date of the Selected Product (as defined in Clause 5 below)

5. Warranty Period Extension. When redeeming the Service and Extended Warranty Reward, you must select one (1) Eligible Product which you would like to apply the Warranty Period Extension (“Selected Product”). Upon redemption of the Service and Extended Warranty Reward, the Warranty Period of the Selected Product will be automatically extended for one (1) more year. For the avoidance of doubts, save and except for the extension of the Warranty Period for one (1) more year, all the other terms and conditions of the Warranty Terms and Conditions shall remain unchanged.

6. Free Inspection/ Calibration/ Oil Change. The coupon for the Free Inspection/ Calibration/ Oil Change shall be valid for a period of two (2) years from the date of redemption of the Service and Extended Warranty Reward. During the validity period of the coupon, you may enjoy any one of the following once free-of-charge:

1. inspection by us or our Authorized Warranty Service Provider of one (1) of your Product(s) which was/were or has/have been registered for Warranty in accordance with the Warranty Terms and Conditions;
2. calibration service if you have any one of the products listed in Schedule 1 attached hereto which was or has been registered for Warranty in accordance with the Warranty Terms and Conditions; or
3. oil change service if you have any one of the products listed in Schedule 1 attached hereto which was or has been registered for Warranty in accordance with the Warranty Terms and Conditions.

7. Free Tool Loan.

     7.1 Validity period. The coupon for the Free Tool Loan shall be valid for a period of two (2) years from the date of redemption of the Service and Extended Warranty Reward.

     7.2 Eligibility. You may use the coupon for the Free Tool Loan to borrow any one (1) of the products listed in Schedule 2 attached hereto (“Designated Products”) only when:

1. Warranty Service Provider is providing Warranty Service to you;
2. the estimated time needed for the Warranty Service that Warranty Service Provider provides you in accordance with Clause 4.1(b) of the Warranty Terms and Conditions is more than seven (7) days; and
3. the Designated Product that you would like to borrow (“Requested Product”) is available in stock.

     7.3 Designated Products. We reserve the right to, at our sole discretion and at any time, change, modify, add to, or delete from, the list of the Designated Products (Schedule 2). You are advised to revisit the list of the Designated Products (Schedule 2) before you use the coupon for the Free Tool Loan.

     7.4 Procedures

1. When you notify Warranty Service Provider in writing that you have discovered a defect or fault in a Product in accordance with Clause 4.1(a) of the Warranty Terms and Conditions, you must at the same time inform Warranty Service Provider of:
   1. your intention to use the coupon for the Free Tool Loan;
   2. the Requested Product; and
   3. whether you would like to:
      1. collect the Requested Product at our Service Center, or any one of our as listed in Schedule 3 attached hereto – and you shall specify your choice of the exact venue for collection; or
      2. have the Requested Product delivered to you (see Clause 7.4(d) below).
2. If the estimated time needed for the Warranty Service is more than seven (7) days, Warranty Service Provider will inform us that you wish to use the coupon for the Free Tool Loan.
3. We will notify you whether the Requested Product is available in stock directly by SMS or phone call, using the contact information you provided to us for the Heavy Duty Club membership.
4. If the Requested Product is available:
   1. in the event that you have chosen to collect the Requested Product at our Service Center or any one of our Authorized Warranty Service Providers per Clause 7.4(a)(3) above, we will inform you of when you may collect the Requested Product (“Collection Date”), and you shall collect the Requested Product at the venue you have chosen for collection within seven (7) days after the Collection Date or until the completion of the Warranty Service, whichever is earlier (“Collection Period”). Upon collection of the Requested Product or expiry of the Collection Period, whichever is earlier, the coupon for the Free Tool Loan in your Membership Account will be deactivated;
   2. in the event that you have chosen to have the Requested Product delivered to you per Clause 7.4(a)(3) above, within three (3) business days after our notification to you per Clause 7.4(c) above, we will dispatch the Requested Product to you free-of-charge, provided that your delivery address is within Thailand. Upon dispatch of the Requested Product, the coupon for the Free Tool Loan in your Membership Account will be deactivated.

     7.5 Return of the borrowed Requested Product (“Borrowed Product”). You must return the Borrowed Product to us within five (5) days from the date when Warranty Service Provider notifies you of the completion of the Warranty Service in accordance with Clause 4.3 of the Warranty Terms and Conditions, by in-person delivery of the Borrowed Product to our Service Center or any Authorized Warranty Service Provider. 

     7.6 Your responsibilities.

1. The Borrowed Product may be used by you for your personal benefit or convenience only. You must not permit a third party to use the Borrowed Product.
2. You must maintain the Borrowed Product in as good condition as when it was received by you, ensuring that it remains undamaged, saleable, and in good working order. From the time of receipt until the return of the Borrowed Product, you are solely responsible for maintenance and repair of the Borrowed Product. You shall be responsible for repair or replacement costs if the Borrowed Product is lost, damaged, destroyed, or stolen.
3. You are solely responsible for the proper use of the Borrowed Product. You agree to use the Borrowed Product at your own risk.

     7.7 Your violation. If you violate any of the terms and conditions under this Clause 7, we reserve the right to revoke and nullify all your other benefits associated with the Service and Extended Warranty Reward.

     7.8 No representations, warranties, or conditions made. To the maximum extent permitted by applicable laws, neither we nor our affiliates make any representations, warranties, or conditions of any kind whatsoever, express or implied, in connection with the Borrowed Product or the use thereof, including, without limitation, warranties of merchantability, or fitness for a particular purpose.

     7.9 Exclusion of Liabilities. To the maximum extent permitted by applicable laws, we, our affiliates, and our respective directors, officers, employees and agents, shall not be liable for any damages, losses, costs, expenses, liabilities, or claims whatsoever, whether direct, indirect, special, punitive, incidental, or consequential, in contract, tort (including negligence), under statute or otherwise, save for willful misconduct, arising out of or in connection with the Free Tool Loan, or any aspect of feature of it, including, without limitation, the Borrowed Product or the use thereof.
